The petitioner seeks bail in connection with Bisfi Police Station Case No. 246 of 2019, registered for the offences punishable under Sections 272/273 of the Indian Penal Code and Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution story, as per the First Information Report, is that while night patrolling, the Police saw two persons indulged in the selling of illicit liquor on a tempo and on seeing the police, they tried to flee away, but the police apprehended them and on search of the tempo, 105 litres of illicit liquor was recovered.

Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged

Patna High Court CR. MISC. No.63380 of 2019(3) dt.04-12-2019 2/2 and referring to paragraph 11 of this application, he submits that the petitioner is not the owner of the tempo, in question. He further submits that the petitioner has got no criminal antecedent and co-accused Dinesh Kumar Sah has been granted bail by this Court by order, dated 14.10.2019, passed in Criminal Misc. No. 61858 of 2019.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is in judicial custody since 25.08.2019 having no criminal antecedent and similarly situated co-accused has been granted bail by this Court, I am inclined to enlarge the petitioner on bail.

This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cum- Special Judge, Excise, Madhubani, in connection with Bisfi Police Station Case No. 246 of 2019.
