2. The petitioner seeks bail in connection with Mufassil P.S. Case No. 503 of 2023 dated 24.06.2023 registered for the offences punishable under Sections 363 and 365 of the I.P.C.

3. As per the prosecution case, the minor daughter of the informant was missing since 24.06.2023 and she had a mobile bearing no. 6200494015. He tried to search out her at several places at his best level but she was not found.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the F.I.R. has been lodged against unknown and the petitioner's name has sprung up in the statement of the victim recorded under Section 164 of the Cr.P.C., in which she has stated that she went to Delhi alone at the house of her aunt (Fua) and when she got down from the trial she forgot the way of her aunt's house, in the meanwhile, she met the petitioner who took her to his house in Delhi and kept her happily. She has further stated that the petitioner has not kidnapped her. It is further submitted that the victim has not alleged any misbehaviour against the petitioner. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 30.06.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Mufassil P.S.
