JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 158 of 2019, disclosing offences under Sections 420, 406, 34 of IPC. As per complaint case allegation has been made against the petitioners that there was an agreement for sale of 10 acres of land with one Amrendra Kumar Verma, for which, Rs. 70 lacs has been given in advance, but later on, complainant came to know that with respect to the said land, a case is pending before the Sub Judge, of which, he asked the petitioners to return the amount, but they are not returning the same, as such, the complainant has been cheated by the petitioners and

Submission of the learned counsel for the petitioners is that petitioner no.1 is wife and petitioner no.2 is son of Amrendra Kumar Verma. Even according to the complaint petition, an agreement was reached between complainant and Amrendra Kumar Verma and amount was given to Amrendra Kumar Verma and no specific act has been attributed against the petitiones. There is no chit of paper to show that amount of Rs.70 lacs has been received by the petitioners. Heard learned A.P.P. as well as learned counsel for the complainant, who has opposed the prayer for anticipatory bail on the ground that Annexure 3 itself shows that payment was made and there is signature of Amrendra Kumar Verma in the agreement showing that the payment has been made.

Having heard both sides, in view of the facts and circumstances, as stated above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J.M.-IX, Gaya, in connection with Complaint Case No.
