JUSTICE SANJAY PRIYA ORAL ORDER 3/ 17-01-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in Supaul P.S. Case No.463 of 2016 instituted for the offence under Section(s) 47-A and 51 of the Bihar Prohibition & Excise Act, 2016 Act. Counsel for the petitioners has submitted that prayer of the petitioners for bail was earlier rejected by this Court by order dated 10.04.2017 passed in Cr. Misc. No.8738 of 2017 with liberty to renew their prayer for bail after six months if no substantial progress is made in the trial.

A report was called for from the Trial Court, which has been received from which it appears that not a single witness has been examined in the case in the Trial Court. The case is

Patna High Court Cr.Misc. No.60827 of 2017 (3) dt.17-01-2018 2/2 pending for evidence.

It has been submitted that the petitioners are in custody since 26.09.2016.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of `10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 1st-cumSpecial Judge (Excise), Supaul, in connection with Supaul P.S. Case No.463 of 2016, subject to the condition that both the bailors shall be close relative of the petitioners. The petitioners shall remain present on each and every date and will not try to influence or delay the trial. Absence of the petitioners on two consecutive dates without any reasonable cause will make their bail bond liable to be cancelled. (Sanjay Priya, J) JA/- U T
