The petitioner is in custody in connection with Bodh Gaya P.S.Case No.302 of 2018 registered for an offence under Sections 370 and 120(B) of the IPC and Section 14 of Foreigner Act, 1946 and Sections 3, 5, 6 and 7 of the Immoral Traffic Prevention Act.
The allegation as per FIR is that police party conducted raid in a house and apprehended this petitioner along with a lady in a suspicious condition.
It has been submitted that the petitioner had stayed in the hotel for servicing of his car on the following day. The police apprehended this petitioner merely on suspicion. The girl who was
Patna High Court Cr.Misc. No.40676 of 2018 (3) dt.25-07-2018 2/2 allegedly apprehended with this petitioner in her statement under Section 164 of the Cr.P.C., has not stated anything against this petitioner.
The learned APP opposed the submissions.
Considering the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Gaya in connection with Bodh Gaya P.S.Case No.302 of 2018 (G.R.No.3131 of 2018) with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
