The petitioner seeks regular bail in connection with Asaon P.S. Case No. 44 of 2017 for the offences punishable under Sections 272/273/308 of the Indian Penal Code and 30(A) of the Bihar Prohibition and Excise Act, 2016.
The allegation against the petitioner is that he was said to be selling illicit liquor and upon seeing the police, he fled away. It is further alleged that from the bushes present near the house of the petitioner, 125 liter of illicit liquor was recovered. The learned counsel for the petitioner submits that no recovery has been effected from the possession of the petitioner, he has a clean antecedent and is in custody since 18.08.2017.
Patna High Court Cr.Misc. No.62874 of 2017 (2) dt.17-01-2018 2/2 Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-2 at Siwan in connection with Asaon P.S. Case No.44 of 2017.
