JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 14-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Lakhisarai (Ramgarh Chowk) P.S. Case No. 56 of 2019 registered for offence punishable under sections 341, 323, 324, 326, 307, 120B/34 of the Indian Penal Code and later on, section 302 of the Indian Penal Code has been added. As per allegation, accused persons badly assaulted the informant, who sustained injuries and after his death, section 302 of the Indian Penal Code. The allegation against this petitioner is that he inflicted blows by Katta on back portion of his head. Rajesh Yadav assaulted him by Katta, Subhash Yadav also assaulted in his leg by Katta.

The deceased was a criminal and he might would have been killed by some unknown persons. There is specific allegation against the petitioner that he inflicted Katta blow on the head of the deceased, who died during the course of treatment.

In my view, the petitioner does not deserve the privileges for regular bail. Accordingly, it is rejected. (Nawneet Kumar Pandey, J) Mahesh/- U T
