JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-03-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 379/307 and other allied sections of the Indian Penal Code.
As per the prosecution case, while the informant was going to Nawada on Scorpio vehicle and reached near Petrol pump, FIR named accused persons and other ten unknown accused persons surrounded his vehicle and started assaulting Arun Yadav who was sitting on the Scorpio vehicle of the informant. On protest, accused persons also assaulted the informant and his driver. It is alleged that the co-accused Chotu Yadav took out Rs.10,000/- from the pocket of the informant and fled away.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. petitioner is
Patna High Court CR. MISC. No.68244 of 2022(2) dt.20-03-2023 2/2 not named in the FIR and his name has surfaced in the case during investigation though no tangible evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. Learned counsel for the State opposes the prayer for bail submitting that the petitioner has got criminal antecedent. Considering the nature of accusation and criminal antecedent of the petitioner, his prayer for bail is refused. (Prabhat Kumar Singh, J) shashi/- U T
