JUSTICE SATYAVRAT VERMA ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. Let the defect(s), if any, be removed within a period of four weeks.

The petitioner apprehends his arrest in a case registered for the offence punishable under Section 498(A) of the Indian Penal Code.

In compliance of the order dated 12.10.2022, the petitioner and the informant are present physically in Court along with their respective counsel.

Without going into the merits of the case, the petitioner, who is present, himself submits that the dispute between the parties has arisen to a level where compromise is

It is further submitted that petitioner is willing to pay a monthly maintenance of Rs.25,000/- to the informant for her upkeep. It is next submitted that petitioner himself submits that the said maintenance amount will be paid to the informant commencing from the month of November, 2022 and will continue till a Court of competent jurisdiction decides the issue of maintenance, if any, filed by the informant. The informant, who is also present in Court, accepts the offers given by the petitioner.

Learned counsel for the informant Mr. Tribhuwan Narayan submits that he will Whatsapp the account number of the informant to the learned counsel for the petitioner Mr. Jagnnath Singh, who is appearing for the petitioner. Learned counsel for the petitioner Mr. Jagnnath Singh undertakes that he will Whatsapp the account number of the informant as provided to the petitioner immediately. The petitioner at this stage submits that the moment he receives the bank account number of the informant he will start depositing the maintenance amount of Rs.25,000/- per month as agreed. Considering the submissions made by the parties, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks

No.68093 of 2019(11) dt.22-11-2022 3/3 from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 580 of 2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. and if the informant brings to the notice of the learned trial court that the petitioner consecutively for two months has not paid the maintenance amount, the learned trial court shall forthwith cancel the bail bonds of the petitioner after recording reasons and will take all coercive steps to ensure that he is behind bar.
