====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 13-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Singhwara P.S. Case No.31 of 2015 registered under Sections 420, 467, 478, 471 and 120(B) of the Indian Penal Code. The accusation of the complainant/informant is that 7 persons, named in the complaint petition, including the petitioner assaulted him and his wife regarding which he lodged the case. Thereafter, the petitioner only to escape, applied for pass-port to go abroad, concealing his real name but, on verification, the same was detected and his application was rejected. Learned counsel for the petitioner submits that, in fact, the petitioner had applied for pass-port but his application was

No.60553 of 2017 (2) dt.13-12-2017 2/2 rejected due to pendency of the case against him and not on the basis of concealing the identity by the petitioner, which would appear from Annexure-2 series to the application, the report of the Sub Inspector of Police, Singhwara, addressed to the Senior Superintendent of Police, Darbhanga.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Singhwara P.S. Case No.31 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
