Petitioner seeks bail in a case registered for the offences punishable under Sections 366A/34, 363, 376, 379 of the Indian Penal Code as well as Sections 6, 8 and 10 of the Protection of Children from Sexual Offenses Act, 2012.
Submission of the learned counsel for the petitioner is that the statement of the victim recorded under Section 164 Cr.P.C. would reveal that the matter is of some previous affairs between the victim and the petitioner. She voluntarily travelled to different places along with the petitioner but never raised any protest or alarm. After break up of relationship, false case has been lodged.
Finding substance in the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.37416 of 2018 (2) dt.03-07-2018 2/2 bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Baligaon Police Station Case No. 46 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
