JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-06-2018 This criminal miscellaneous has been filed for modification in the order dated 11.01.2018 passed in Cr. Misc. Mo. 49261 of 2017 on the ground that the petitioner could not arrange the stipulated amount within the prescribed time as his mother was seriously ill so he failed to surrender in accordance with the direction given in the said order. The petitioner filed Cr. Misc. No. 16501 of 2018 for modification in the said order which was also allowed and four weeks time was granted to the petitioner to pay Rs. 34000/- by way of first installment to the complainant and to surrender in the court below but due to ill luck, again the petitioner did not arrange the said amount and now the amount has been arranged and bank draft of Rs.

Patna High Court Cr.Misc. No.37165 of 2018(2) dt.27-06-2018 2/2 36,000/- has been got issued in the name of Santosh Kumar, the complainant and, as such, further three weeks time be extended to surrender.

Considering the prayer of the petitioner and further that bank draft of Rs. 36,000/- has already been issued by the Central Bank of India, in the name of Santosh Kumar (complainant) and, as such, further three weeks time is granted to the petitioner to deposit the said bank draft by way of first installment and to surrender in the court below and then he shall be released on provisional bail as per terms and conditions of the order dated 11.01.2018 passed in Cr. Misc. No. 49261 of 2017 and accordingly, this criminal miscellaneous for modification stands allowed.
