The petitioner is in custody since 03.06.2019 in connection with Khodabandpur (Chhurahi O.P) P.S. Case No. 110 of 2019 for the offence registered under Sections 401, 411, 413, 414, 465, 466 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that name of the petitioner has surfaced on the basis of the confessional statement made before the police by co-accused, namely, Prince Kumar. It is further submitted that the alleged recoveries were not made from the conscious possession of the petitioner rather the same has been recovered from one Shobhit Yadav, who has also taken the name of the present petitioner. It is further submitted that no incriminating article was recovered from the

No.69983 of 2019(2) dt.19-11-2019 2/2 possession of the petitioner and similarly situated co-accused persons, namely, Aman Kumar and Mithlesh Kumar have been granted bail by this Court vide order dated 24.07.2019 & 06.09.2019 passed in Cr. Misc. No. 45885 and 2019 & 56520 of 2019.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Manjhaul at Begusarai in connection with Khodabandpur (Chhaurahi O.P.) P.S. Case No. 110 of 2019.
