2. The petitioner apprehends his arrest in a case registered for the offence under Sections 126(2), 303(2), 308(2), 109(1) & 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.
3. The prosecution case, in brief, is that on 07.05.2025 at about 10:30 PM, the informant was returning home from Mahthaur on his motorcycle and as he reached near Middle School, this petitioner stopped him and demanded money and thereafter, other accused persons snatched cash of Rs. 5,000/-, gold chain and Aadhar Card from the informant. It is further alleged that co-accused Vikash Yadav fired three shots at informant, out of which, one bullet hit stomach of informant.

4. Learned counsel for the petitioner submits that there is absolutely no allegation of assault against this petitioner. Specific allegation of firing is against other co-accused. Petitioner is only alleged to have stopped informant and demanded money. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State and learned counsel for the informant opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Benipur, Darbhanga in connection with Bahera P.S. Case No. 160 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) anay U T
