2. The petitioner is in custody since 03.08.2023 in connection with Buxar Excise P.S. Case No. 581 of 2023 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, there is recovery of 41.250 litres of illegal liquor from the Scorpio vehicle.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the petitioner is the driver of the vehicle from which recovery has been made and he has no knowledge about the consignment. He further submits that the petitioner has no concern with the alleged recovery of illicit liquor. The petitioner

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-2, Buxar in connection with Buxar Excise P.S. Case No. 581 of 2023.

7. The petitioner is directed to mark his attendance in Shahpur Patori police station on 1st Sunday of every month. (Sandeep Kumar, J) Saif/- U T
