Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Submission is that daughter of the informant committed suicide being frustrated by eve teaching of co-accused Sumant Kumar and Santu Kumar. However, allegation in the FIR is that the named accused persons including the petitioner allegedly strangulated her. Submission is that the petitioner has been falsely implicated for the reason that she is mother of Sumant Kumar. Further submission is that co-accused Ajay Singh, having similar allegation, has already been allowed bail by a Coordinate Bench of this Court vide order dated 22.05.2018 passed in Cr.
Patna High Court Cr.Misc. No.37671 of 2018 (2) dt.06-07-2018 2/2 Misc. No. 21730 of 2018 (Annexure-2).
Considering the aforesaid fact, let the petitioner, above named, who is a female be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hulasganj Police Station Case No. 18 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
