2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 21, 22, 23 of the N.D.P.S. Act.

3. Allegation against the petitioner is to have involved in illegal trade of narcotic drung along with other co-accused persons, where, there is recovery of total 727.7 liters of syrup containing codeine from the Godown.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner has no concern with the alleged recovery of narcotic substance and the

Neither the petitioner was apprehended on spot nor any incriminating article has been recovered from his conscious possession. His name came into light on the basis of disclosure of co-accused Nausad. It is further submitted that the petitioner is languishing in judicial custody since 3.8.2023. Moreover, coaccused Md. Kamran has already been enlarged on bail granted by a co-ordinate bench of this Court vide order dt. 28.2.2024 passed in Cr. Misc. No. 54588 of 2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Araria (RS) P.S. Case No. 524 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Spl Judge, NDPS, Araria.
