====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-12-2017 Heard learned counsels for the petitioner and State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 469, 471 and 120B of the IPC.

The prosecution case is that co-accused Smt. Bala Devi and Vivekanand Sharma got 47 decimals of land of the informant transferred by setting up a fictitious person who impersonated the informant. It is alleged against the petitioner that he was the identifier of the sale deed.

It is submitted by learned counsel for the petitioner that thrust of accusation is against co-accused Smt. Bala Devi and Vivekanand Sharma. For civil nature of dispute, the accusation has been levelled. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal

Considering the nature of accusation arising out of civil nature of dispute and the fact that thrust of accusation is against above named co-accused persons, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No. 255 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
