The petitioner, being the elder brother of the husband of the victim, is apprehending arrest in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code.

Prosecution case is that the sister of the informant, namely, Babita Kumari, was married with Satish Sah, but subsequent to the marriage, there was further dowry demand of Rupees Two Lacs and due to non-fulfillment of the same, the sister of the was threatened to kill. It is alleged that on 01.06.2019, the brother of the informant conveyed him on telephone that his sister has been burnt to death by the in-laws people. After having received such information, when the informant reached

Patna High Court CR. MISC. No.77195 of 2019(2) dt.27-11-2019 2/2 to the in-laws house of his sister, he found her dead body lying in the courtyard in burnt condition.

It is submitted by learned counsel for the petitioner that the accusation is omnibus and general against all the in-laws people, including the petitioner, and moreover, the thrust of accusation is against the husband of the victim.

It is submitted by learned APP for the State that the petitioner is named in the FIR.

Considering the accusation being omnibus and general and the thrust of accusation being against the husband of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur, in connection with Deoria P.S. Case No.73 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
