JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 The petitioner seeks regular bail in connection with Dhoraiya P.S. Case No. 58/2014, registered for offences punishable under Sections 364, 302, 120B and 34 of the Indian Penal Code.
Prosecution case is that petitioner and one co-accused called the husband of deceased and later on his dead body was found into a well.
Submission of learned counsel for the petitioner is that save and except suspicion, there is absolutely nothing against the petitioner. Further submission is that earlier a U.D. case was filed but after 27 days the present case has been field by filing complaint petition, which was subsequently sent for registration of F.I.R. under Section 156(3) Cr.P.C. It has also been submitted
Patna High Court CR. MISC. No.67177 of 2019(3) dt.09-01-2020 2/2 that similarly situated co-accused, has been granted the privilege of anticipatory bail vide order dated 16.01.2019 passed in Cr. Misc. No. 76043 of 2018, whereas, the petitioner has been in custody since 18.03.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Dhoraiya P.S. Case No. 58/2014, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
