2. The petitioner seeks bail in connection with Asthawa P.S. Case No. 107 of 2023 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 354, 379, 342 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

3. The petitioner is said to have shot at the victim which hit the victim in the stomach. The deceased had to remain in hospital for more than 15 days and he suffered life threatening injury i.e., perforation has been caused in his stomach.

4. At the outset, learned counsel for the petitioner without accepting the guilt of the petitioner has submitted that

Patna High Court CR. MISC. No.75614 of 2023(3) dt.27-02-2024 2/2 the petitioner is ready to compensate the victim by paying an amount of Rs. 1,00,000/- (one lakh) on the treatment of the victim as medical assistance.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Nalanda at Biharsharif in connection with Asthawa P.S. Case No. 107 of 2023.

6. At the time of furnishing the bail bonds, the petitioner shall furnish a demand draft of Rs. 1,00,000/- (one lakh) prepared in the name of the victim. If the petitioner furnishes the demand draft of Rs. 1,00,000/- (one lakh) the Court below shall accept the bail bonds of the petitioner and hand over the said demand draft to the victim.
