2. The petitioner has preferred this application for grant of regular bail in connection with Patori P.S. Case No. 414 of 2019 registered for the offences punishable under Section 394 of the Indian Penal Code.
3. As per the prosecution story, the informant alleges that the informant was working as a cashier in Midland Micro Finance Company. On the alleged date of occurrence, four culprits two of which were armed with pistols, barged into the office and demanded cash from the informant on gun point. The culprits forcibly took the informant to the locker room on the gun point and tried to open the locker but could not succeed.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case only on the basis of false, baseless and concocted allegation. The petitioner is not named in the FIR, his name has been transpired on the basis of the confessional statement of coaccused persons namely Suraj Veer @ Shoor Veer as per para 153/154 of the case diary after lapse of five years from the date of FIR. No Test Identification Parade (TIP) has been conducted till now. The co-accused person Suraj Veer @ Shoor Veer on whose confessional statement the name of the petitioner has been transpired in this case has already been granted bail by the Co-ordinate Bench of this Court vide Order dated 19.07.2024 in Cr. Misc. No. 49435 of 2024. The charge-sheet has been submitted stating that nothing has been recovered from the possession of the petitioner. The petitioner has three criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 26.06.2025.
5. Learned APP appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
6. Keeping in view the aforesaid facts and considering

No.67940 of 2025(2) dt.24-09-2025 3/3 the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Session Judge - IX, Samastipur in connection with Patori P.S. Case No. 414 of 2019 subject to the following conditions:- (i) Petitioner will remain physically present in trial on each and every date till the disposal of the case failing which, on two consecutive dates without reasonable cause, the bail bond of the petitioner may be cancelled by the Trial Court.
