2. The petitioners seek bail in connection with Sonpur P.S. Case No. 116 of 2016 registered for the offence punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, during course of investigation, one country made pistol, sisam Danda aad other articles were recovered from a ditch situated by the side of Railway track.

4. Learned counsel for the petitioners submits that the petitioners are innocent and has been falsely implicated in this case. Learned counsel submits that in a case of Arms Act,

Patna High Court CR. MISC. No.71504 of 2023(2) dt.07-11-2023 2/2 there is no recovery from the possession of the petitioners who are in jail since 04.07.2023 and 16.06.2023 respectively.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioners.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Saran, Chapra in connection with Sonpur P.S. Case No. 116 of 2016, subject to the condition that the petitioners will co-operate in the case.

7. The petitioners will also mark attendance in Baniyapur Police Station, District-Saran on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioners. (Sandeep Kumar, J) P. Kumar U T
