The petitioners seeks bail in Triveniganj P.S. Case No. 147 of 2018 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code. Informant is the Police Sub Inspector who in his written report has stated that on 17.04.2018 when he was on patrolling duty he received secret information that some miscreants are unloading food bags from the truck near FCI godown and when he reached the spot along with police party four persons including the petitioners have been arrested while
Patna High Court Cr.Misc. No.39832 of 2018(2) dt.11-07-2018 2/2 other miscreants managed to flee away.
It has been submitted on behalf of the petitioners that the petitioners have been falsely implicated in this case and no incriminating article has been recovered from the possession of the petitioners. It has further been submitted that similarly situated co-accused person Mukesh Kumar Yadav s/o Bharat Lal Yadav, has been granted bail by a co-ordinate bench of this Court vide order dated 09.07.2018 passed in Criminal Miscellaneous No. 38296 of 2018. Petitioners have got no criminal antecedent and are in custody since 19.04.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Supaul, in connection with Triveniganj P.S. Case No. 147 of 2018.
