It appears that a supplementary affidavit has been filed in the present restoration application stating therein that respondent No. 4 of the said CWJC No. 20157 of 2016 is no more and accordingly it has been stated that in his place, name of his son, namely, Sri Rakesh Kumar be substituted after expunging his name.

Considering the averments made in the supplementary affidavit filed on behalf of the petitioner, let the name of respondent No. 4 be expunged from the cause title of this case

Patna High Court MJC No.3958 of 2019(8) dt.22-02-2023 2/2 and in his place, name of Sri Rakesh Kumar, as described in paragraph 5 of the supplementary affidavit be substituted. Considering the facts and circumstances, this application is allowed. Let CWJC No. 20157 of 2016 be restored to its original file.
