2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 352 and 351(1) of the B.N.S..

3. As per prosecution case, on account of pre-existing land dispute, on 14.03.2025, all the F.I.R. named accused persons, including this petitioner, assaulted informant and his family members. This petitioner is alleged to have assaulted on the head of brother of informant, namely Amrendra Tiwari with bricks.

4. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.68186 of 2025(3) dt.19-12-2025 2/2 that petitioner is quite innocent and has committed no offence. As a matter of fact, on account of pre-existing land dispute, simple scuffle took place between the parties in which both sides sustained injuries. There is case and counter-case. Moreover, charge-sheet has already been submitted and petitioner is in custody since 22.07.2025.

5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, case and counter-case and period of custody, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Siwan in connection with Basantpur P.S.
