The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 329(3), 126(2), 115, 74, 109, 352, 351(2), 3(5) of the BNS and 27 of the Arms Act. 3.
As per the FIR, the petitioner and other co-accused persons assaulted the informant and his family members due to which they sustained injuries.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. There is no specific overt act against the petitioner. The allegation against the petitioner is that he fired upon the father of the informant but no
Patna High Court CR. MISC. No.71554 of 2024(2) dt.23-10-2024 2/2 one has sustained fire arm injury in the entire occurrence. It is further submitted that two co-accused persons have already been granted anticipatory bail by the learned Court below. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his/her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Mohaniya P.S. Case No.410 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.
