2. The petitioner apprehends his arrest in connection with Daudpur P.S. Case No. 287 of 2022 dated 07.10.2022 registered for the offences punishable under Sections 302/120(B)/34 of the Indian Penal Code.

3. As per prosecution story, the petitioner along with other accused persons brutally murdered the victim by causing several stab injuries.

4. The main submissions advanced by learned counsel appearing for the petitioner are that though the petitioner is

No.72365 of 2024(3) dt.22-11-2024 2/3 named in the F.I.R. but there is no specific allegation against him and he did not play any role in the alleged occurrence and during investigation, some independent witnesses revealed the petitioner's innocence and according to the Investigating Officer, after the verification of mobile location, petitioner was not present at the place of occurrence at the relevant time and considering these circumstances, the petitioner was not sent up by the police.

On the other hand, learned APP for the State has opposed the prayer for bail of the petitioner and submits that the instant matter relates to heinous offence of brutal murder in which the informant's son who was pursuing B.Tech was brutally murdered by inflicting nine stab injuries to him and the informant, his wife and his son are said to be eyewitnesses who fully supported the allegation made against the petitioner in the F.I.R.

Considering the seriousness of the allegation appearing against this petitioner from the F.I.R. and getting support from the statements of the material witnesses whose statements are mentioned in the paragraph no. 6, 7 and 8 of case diary and according to them this petitioner and co-accused persons brutally assaulted the victim by inflicting several knife

Patna High Court CR. MISC. No.72365 of 2024(3) dt.22-11-2024 3/3 blows and on the body of the deceased 9 stab injuries were found, in my opinion, it is not a fit case for bail to the petitioner, accordingly, his prayer stands rejected.
