====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 17-10-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in a case for the offence registered under Sections 188, 333, 353, 307, 427, 272, 273, 279, 337, 338/34 of the IPC, 30(a) of the Bihar Prohibition and Excise Act, 2016 and 25(1-b)a, 26 and 27 of the Arms Act. The prosecution story, in brief, is that on 24.05.2019 the informant tried to stop one Scorpio vehicle but the said vehicle knocked the police jeep and pushed the police jeep 4-5 times due to which police jeep became damaged. The Scorpio vehicle got fallen in a ditch and the boarding persons fled away out of which, Bablu Yadav, Anjani Jha and Laxman Kamat were identified by the local Chaukidar. It is also alleged that 128.25 liters wine and other articles are said to have been recovered from the said vehicle.
Patna High Court CR. MISC. No.65798 of 2019(2) dt.17-10-2019 2/2 It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 26.05.2019. Charge sheet/prosecution report has been submitted in the present case. The petitioner has got no criminal antecedent. He has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. No arms is said to have been recovered from possession of the petitioner. None is said to have been injured in course of occurrence.
On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R/ complaint case.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.- IInd-cum-Special Judge (Excise Act), Darbhanga, in connection with Darbhanga Manigachi (Sadar) P.S. Case No. 103 of 2019, G.O. Case No. 499 of 2019.
