JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 25.07.2017 passed in Cr. Misc. No. 33435 of 2017 with an observation to conclude the trial within a period of nine months.

Submission of learned counsel for the petitioner is that nine months period has already expired and uptil now charge has not been framed in this case. Further submission is that the petitioner is in custody for more than one year and there was recovery of only 3 kg of Ganja which is less than commercial quantity.

Having heard both sides and in the facts and circumstances, as stated above, considering the period of custody

Patna High Court Cr.Misc. No.33498 of 2018 (2) dt.22-06-2018 2/2 year, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Ist Additional Sessions Judge, Banka, in connection with Katoria P.S. Case No. 50 of 2017, G. R. No. 1154 of 2017 on the condition that one of the bailors shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and further condition that the petitioner shall co-operate in disposal of the trial.
