====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 13-07-2018 Heard learned counsels for the petitioner and the State. Learned counsel for the petitioner is permitted to make necessary correction in para-10 of the application with regard to period of custody of the petitioner in course of the day. The petitioner, already in custody, seeks bail in connection with Hasanpur P.S.Case No. 255 of 2016 registered under Sections 302/34 of the Indian penal Code. Allegation in brief is that informant's husband was killed by accused persons, named in the FIR, on account of some dispute with the landlord and Jhunjhun Kumar wanted to remove him from the tenancy and also one Suraj Turha did not intent to return back money.

Submission is that petitioner is not named in the FIR, his name transpired in the confessional statement of co-accused Ram Kalyan Das that petitioner was also involved in the alleged

Patna High Court Cr.Misc. No.42281 of 2018(2) dt.13-07-2018 2/2 offence and Ram Kalyan Das and Gajendra Paswan were admitted to bail by the co-ordinate Benches of this Court vide Cr. Misc. No. 21507 of 2017 and Cr. Misc. No. 34966 of 2017 and petitioner has no criminal antecedent except one case lodged under Section 366A of I.P.C.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Rohit Kumar @ Rohit Paswan is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-3rd, Rosera, Samastipur in connection with Hasanpur P.S.
