1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109, 103(1), 352, 3(5) of B.N.S.

3. The learned counsel for the petitioner submits that the petitioner has antecedent of one case and the allegation in the FIR in sum and substance is that after immersion of Goddess Saraswati, the named accused persons including the petitioner along with 35-40 unknown accused armed with lathi, danda, rod, etc. restrained the informant and his side and further Balister Sah assaulted the father of the informant by an iron rod on head causing injury and he died at the spot, thereafter the

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioner rather specific allegation of assaulting the father of the informant is against Balister Sah. It is also submitted that petitioner will not abscond rather will cooperate in the investigation to prove his innocence. It is next submitted that Ranjan Singh @ Ranjan Kumar had approached this Court seeking anticipatory bail application by filing Cr. Misc. No.32937 of 2025 and the same was allowed by a learned Coordinate Bench by an order dated 13.08.2025 and the case of the petitioner is similar to the case of Ranjan Singh.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail

No.67417 of 2025(2) dt.07-10-2025 3/3 on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Siwan Muffasil P. S. Case No.82 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
