ANJANA MISHRA ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in custody since 04.07.2017 in connection with a case registered for the offences punishable under Sections 147/148/149/341/307/302/120(B) of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that neither he is named in the First Information Report nor was he arrested at the spot. It is further submitted that no incriminating material has been recovered from his possession. Learned counsel for the State, however, submits that the name of the petitioner appears to have figured in the statement made by two witnesses who were said to be present at the place of
Patna High Court Cr.Misc. No.59093 of 2017 (2) dt.12-12-2017 2/2 occurrence but the allegations made out are wholly vague and do not fit into the picture as has been made out in the First Information Report.
Learned counsel for the petitioner further submits that only because he had been interacting with some of the persons in the jail, therefore, on suspicion his name has also been included in connection with the present case. He further submits that the persons who are named in the First Information Report have all been granted regular bail in Cr. Misc. No. 25233/2016, Cr. Misc. No. 42986/2016, Cr. Misc. No. 14318/2016 and Cr. Misc. No. 53923/2016 vide order dated 11.08.2016, 15.12.2016, 16.05.2016 and 13.01.2017 respectively.
Considering the aforementioned fact and circumstances and since the petitioner is in jail since 04.07.2017, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur, in connection with Danapur P.S.
