2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 363/366(A) of the Indian Penal Code.

3. The case of the prosecution is that the minor daughter of the informant is missing. When she did not return for a considerable time, the informant searched her and he believes that the petitioner has kidnapped his daughter.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. During the course of

No.72943 of 2024(5) dt.04-02-2025 2/3 investigation, victim girl has recovered and she has given her statement under Sections 161 as well as 164 of the Cr.P.C. wherein she stated that she was on talking terms with the petitioner and they planned to flee away from the house and on 22.05.2024 she herself called the petitioner at Ramchandrapur Bus stand and from there, they went to Delhi, there she lived for a month with the petitioner and when she came to know that her family members have filed a case they returned from there. From perusal of the statement of the victim, it is clear that she was not kidnapped rather she herself has gone with the petitioner. It is a case of adolescence affair outside marriage. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 26.06.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Laheri P.S. Case No. 248 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount
