2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per prosecution case, the informant namely, Arun Kumar Singh alleged that on 22.09.2022, while he was on his way to home after returning from Danapur Court, three named co-accused persons including the petitioner came on a motorcycle and surrounded him, thereafter, the informant tried to flee towards the home of Brajnandan Rai. In the meantime, Dhananjay Kumar fired from the pistol and the bullet passed through scratching the palm of his right hand and he fell down and thereafter, Taj Pratap assaulted him by leg and pressed his neck by foot.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. From perusal of FIR it appears that there is no specific allegation of any assault or overt act attributed against the petitioner, rather the specific allegation of firing is attributed against Dhananjay Kumar and the petitioner was only alleged to be present at the place of occurrence.

5. Learned APP for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, let the petitioner, above-named, in the event of his arrest / surrender before the learned trial Court within a period of eight weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur in connection with Maner P.S. Case No. 679 of 2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S., 2023. (Prabhat Kumar Singh, J) Shahnawaz/- U T
