The petitioners, who are in custody, seek bail in connection with Narpatganj P.S. Case No. 263 of 2017 registered for the offence punishable under Sections 448, 341, 323, 324, 354B, 379, 436, 504, 506/34 of the Indian Penal Code. Informant has alleged in her written complaint that on 22.05.2017 at about 8.00 PM when she was cooking food in her courtyard, 8-10 persons entered and started abusing her and her husband and also assaulted her and threatened to vacate the land otherwise they will kill him. No.39907 of 2018(2) dt.12-07-2018 2/2 informant and allegation against petitioner No. 2 is snatching a silver chain and after threatening they went away and also took away Rs. 30,000/- from the box after breaking it open. The brother and husband were being treated in Nepal. It has been submitted on behalf of counsel for the petitioner that petitioners have been implicated in this case due to land dispute. The incident is of 22.05.2017 but FIR was lodged on 11.06.2017. It has been further submitted that named accused has already been granted anticipatory bail by this Court as contained in Annexure-1. Petitioners have no criminal antecedent and they are in custody since 17.02.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Araria, in connection with Narpatganj P.S. Case No. 263 of 2017.
