JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 18.9.2017 passed in Cr.Misc.No.35099 of 2017. Allegation is of recovery of 790 kg. of ganja. Submission of learned counsel for the petitioner is that the main accused persons from whom the ganja was recovered has been granted bail by a co-ordinate Bench of this Court vide order dated 18.8.2017 passed in Cr.Misc.No. 28513 of 2017 and vide order dated 4.1.2018 passed in Cr.Misc.No.45806 of 2017. Further submission is that petitioner is in custody since 16.12.2016. Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees
Patna High Court Cr.Misc. No.40842 of 2018 (3) dt.18-07-2018 2/2 twenty five thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, N.D.P.S. Act, Aurangabad, in connection with Aurangabad Muffasil P.S.Case No. 164 of 2016, G.R.No. 12/16/5/17, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bond shall be cancelled.
