The petitioner has been in custody since 21.03.2018 in connection with Kusheshwar Asthan P.S. Case No. 42 of 2018 registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that he has not been named in the First Information Report, but on suspicion he was taken into custody and then on the basis of his confessional statement made before the police, the petitioner is being prosecuted. It is further submitted that there has been no recovery from the possession of the petitioner and he has got no criminal antecedent, let the petitioner above named, be released on bail on

Patna High Court Cr.Misc. No.38313 of 2018 (3) dt.26-07-2018 2/2 furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Biraul, Darbhanga, in connection with Kusheshwar Asthan P.S. Case No. 42 of 2018.
