2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 504, 506, 307, 379, 427/34 of the Indian Penal Code.
3. As per F.I.R., petitioner is alleged to have assaulted on the head of the informant with axe due to which he sustained injury .
4. It is submitted on behalf of the petitioner that he has falsely been implicated in this case merely because he happens to be the son-in-law of one Anoj Yadav with whom informant is having some land dispute . It is further submitted that no such occurrence took place as alleged in the FIR and this
Patna High Court CR. MISC. No.75364 of 2023(2) dt.29-11-2023 2/2 case is the counter blast of Kasim Bazar P . S Case No. 53 of 2022 which was lodged by the father-in-law of the petitioner against the informant and others. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C . J . M, Munger in connection with Kasim Bazar P.S. case No. 45 of 2022 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
