2. The petitioner is praying for regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

3. The case of the prosecution is that altogether 3.340 liters of foreign liquor was recovered from the Almirah in back side room of the general store of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and have committed no offence. The petitioner has falsely been implicated in this case. It is further submitted that neither the petitioner was apprehended from the place of occurrence nor anything has been recovered from his possession. The petitioner is in custody since 27.08.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, as well as, custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ramnagar P.S. Case No.361 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bagaha, West Champaran.

7. Accordingly, the present bail application stands allowed.
