JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Dalsingsarai P.S. Case No. 141 of 2018 for the offence under Sections 30(a), 38(1)(2) and 41 (1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody in connection with seizure of 07 liters of liquor. Petitioner is in custody since 27.05.2018. Learned counsel submits that petitioner has labourer, he has no concerned with the alleged wine and further nothing was seized from the conscious possession of the petitioner.

Considering the fact that the petitioner has no criminal antecedent, the petitioner, named above, is directed to be

No.39107 of 2018(2) dt.09-07-2018 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judgecum-Special Judge, Excise, Samastipur in connection with Dalsingsarai P.S. Case No. 141 of 2018.
