JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 17-03-2025 Heard Mr. Pankaj Kumar, learned counsel for the petitioner, Mr. Rabindra Prasad Singh, learned counsel for the informant and Mr. Rajendra Prasad Nat, learned APP for the State.

2. The petitioner has prayed for bail in connection with Deepnagar P.S. Case No. 249 of 2024 registered for the offence punishable under Section 96 of B.N.S.

3. The case of the prosecution is that the minor daughter of the informant has gone to purchase vegetable but she did not return till night. After that, she was being searched by the informant. The informant came to know that his daughter

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. During course of investigation, the victim has given her statement under Section 183 of the B.N.S.S. wherein she has stated that she went to Jhakhada on auto where Karan has come and from there, they went to Patna. She has also stated that she liked Karan. They started living in a rented flat at Patna. After three days, they left the flat. She has also stated that prior to this she has gone to Patna with Karan in June 2024 and they have solemnized marriage in a temple. From perusal of the case diary, it also transpires that the victim has denied for medical examination. From perusal of the entire materials, it transpires that the victim has gone with the petitioner with her own will. She was not enticed or kidnapped. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. He is languishing in judicial custody since 01.08.2024.

5. The application for bail is vehemently opposed by learned APP for the State and learned counsel for the informant.

6. Having heard learned counsel for the parties and

The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif in connection with Deepnagar P.S. Case No. 249 of 2024.
