JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with P.R. No. 54 of 2017, corresponding to Excise Case No. 877 of 2017, registered for the offence punishable under Section 30(A) of Bihar Prohibition and Excise Act. As per FIR police apprehended one Sumo Gold car and accused persons, including the petitioner succeeded in fleeing away and there was recovery of 225 litres of liquor from the said vehicle.
Submission of learned counsel for the petitioner is that he has falsely been implicated, having no criminal antecedent and there is no source of information that it is the petitioner who succeeded in fleeing away and other co-accused persons have been granted anticipatory bail by co-ordinate
Patna High Court CR. MISC. No.67660 of 2019(2) dt.24-10-2019 2/2 Bench of this Court by order dated 19.1.2018 passed in Cr.Misc.No. 2943 of 2018 and by order dated 27.9.2018 passed in Cr.Misc.No. 57001 of 2018 (Annexure-2 series). Heard learned APP also.
In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Jude, Excise, Supaul, in connection with P.R. No. 54 of 2017, corresponding to Excise Case No. 877 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
