ABHISHEK REDDY ORAL ORDER 22-04-2026 In the counter affidavit filed by the Respondent No. 06, at para 12, 13, 14 and 15 it is specifically stated as under:- "12. That as per billing details net MMG adjustment amount by 13,70,765.75 was finalized and sent to the G.M. (Revenue) SBPDCL for approval. The same was approved by GM (Finance), SBPDCL vide letter no. 721 dated 08.05.2024 and thereafter under Industrial Incentive Policy, 2011 benefit

Patna High Court CWJC No.15450 of 2024(15) dt.22-04-2026 2/3 was passed to the petitioner-consumer for the above said period for Rs. 13,70,765/-.

13. That after adjustment consumer was having net final bill amount of Rs. 6,18,514.25 (19,89,28113,70,765.75) on 06.06.2024 which includes energy charges, DPS, fixed charges and others which has not been paid by the petitioner-consumer.

14. That the balance current DPS amount of Rs. 3,96,128.52 was already adjusted and hence after DPS adjustment the petitioner is having current dues of Rs. 2,22,387 as on 12.11.2024 which includes energy charges, DPS & fixed charges, etc. Therefore now in place of Rs. 6,18,514.88 as existing on 06.06.2024 the petitioner is having current dues of only Rs. 2,22,386.36 as on 12.11.2024 which the petitioner is liable to deposit.

Xerox copy of energy bill dated April 2017 prepared on 27.08.2018 after giving the benefit of IIP and DPS amount is enclosed as Annexure R/1 to the counter affidavit.

15, That in so far as the second claim with respect to consider the representation of the petitioner dated 07.09.2024 is concerned as per Annexure-P/2 of the writ petition the respondent has already deducted/adjusted DPS amount of Rs. 3,96,128.52 and thereafter now

The copy of the revised bill issued to the petitioner is annexed as Annexure R/1 and the same reveals that the MMC is fixed at Rs. 1,03,065.30/-, while the fixed charge and energy charge have been reduced to Rs. 2,22,387/-. In case the petitioner is aggrieved by the same, he is free to approach the CGRF questioning the same.

3. In case the petitioner files any application before the CGRF questioning the bill (Annexure R/1), the CGRF is requested to dispose of the said application as expeditiously as possible preferably within a period of 4 weeks from the date of receipt of said application.

4. With the above direction, the present writ petition stands disposed of.
