JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 This application has been filed for modification of the judgment dated 04.04.2019 passed in Criminal Appeal (S.J.) No. 582 of 2019, from which, it appears that on submission of appellant no.1 that he is ready to execute the sale deed with respect to a piece of land, if some time is granted to him, she was directed to surrender on 05.06.2019 and on that day, the opposite party no.2 shall also remain present in the Court and it is expected that on that day, he will execute a sale deed with
Patna High Court CR. MISC. No.84248 of 2019(2) dt.05-02-2020 2/2 respect to a land and hand over the same to the opposite party no.2 and the court below will verify the same and once the court is satisfied, the court below will release him on bail to its own satisfaction.
However, now a submission has been made with respect to the land that he has already executed the sale deed much prior.
Considering the submissions, made above, as order has been passed in presence of the learned counsel for the parties, I am not inclined to interfere with the earlier order passed by this Court. However, if the petitioner surrender and made prayer for bail, learned court below shall verify the above submission, while disposing of his bail application.
