JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-11-2023 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Barauni P.S. Case No. 318 of 2023 registered for the offences punishable under Sections-341, 323, 324, 307, 379, 354, 504, 506/34 of the Indian Penal Code.

Allegedly, in the backdrop of grazing goats, altercation took place between the parties and in consequence thereof, the accused persons having armed with pistol, lathi, danda etc came

Patna High Court CR. MISC. No.72134 of 2023(2) dt.07-11-2023 2/2 to the house of the informant and assaulted her husband and in the said episode, the son of the informant sustained injury. Learned counsel for the petitioners has submitted that they have falsely been implicated in the present case. There is case and counter case between the parties and the allegations against the petitioners are general and omnibus. He has further submitted that the injuries suffered by the injured persons are simple in nature.

Learned Additional Public Prosecutor opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 318 of 2023 , subject to condition as laid down under section 438(2) Cr. P.C.
