JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Saraiya P. S. Case No. 469 of 2019, registered for the offence punishable under Section 414, 34 of the Indian Penal Code. The informant seized one vehicle and the spy of the police disclosed that the aforesaid seized vehicle belongs to the petitioner and the aforesaid seized vehicle was stolen property. Submission on behalf of the petitioner is that neither the seized vehicle was recovered either from possession or from the house of the petitioner and, moreover, except the discloser made by spy of the police, there was nothing against the petitioner, who does not have any criminal antecedent.

No.66939 of 2019(2) dt.27-11-2019 2/2 Regard being had to the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner, above named, in the event of his arrest/surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, West cum Sub Judge, Muzaffarpur in connection with Saraiya P. S. Case No. 469 of 2019, subject to conditions as laid down under Section 438(2) of the CrPC.
