The petitioner seeks bail in connection with East Champaran Complaint Case No. 1749 of 2022 instituted for the offence under Sections 323 & 498A of the Indian Penal Code. Earlier vide order dated 08.11.2023, passed in Cr. Misc. No. 50561 of 2023, anticipatory bail of the petitioner was granted by a Co-ordinate Bench of this Court with condition. 3.

As per the complaint petition, marriage of complainant with the petitioner was solemnized on 11.07.2019. After marriage, the accused persons including the petitioner

Patna High Court CR. MISC. No.68466 of 2025(4) dt.19-11-2025 2/3 demanded motorcycle as dowry and committed cruelty upon her due to non-fulfillment of the same and lastly on 09.11.2021, the complainant was ousted from her matrimonial home. 4.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.06.2025. Petitioner bears no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that petitioner was enlarged on anticipatory bail with condition that the petitioner shall deposit a sum of Rs. 5000/- per month, but due to non-compliance of same, he was arrested. At this juncture, it is submitted that petitioner is not in a position to pay the amount but at the same time, he is willing to live with complainant with full honor and dignity.

Learned A.P.P. for the State as also learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and nature of accusation, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with East Champaran Complaint Case No. 1749 of 2022.
