1. Heard learned counsel for the parties.

2. The petitioner has filed the instant application for grant of regular bail in connection with Imamganj P.S. Case no. 157 of 2023 registered under sections 307, 341, 323, 354B, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that while he resides for his work in Delhi, the petitioner herein who happens to be his full brother forced his wife to establish illicit relations with him and on her refusal, assaulted her.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. From the contents of the FIR itself it would transpire that the petitioner and the informant are full brothers and it is on account of family dispute that the FIR with false allegations have been lodged. It is further stated that from the FIR it would also been evident

In such circumstances the allegations levelled by the informant is not only false but preposterous. The petitioner has no criminal antecedent and is in custody since 26.6.2023.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the relationship with the parties, the submissions made on behalf of the petitioner, the petitioner having remained in custody since 26.6.2023 and charge-sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Imamganj P.S. Case no. 157 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sherghati, Gaya.
