2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 103(1), 238 and 3(5) of the B.N.S.

3. The case of the prosecution in short is that the son of the informant was killed by some unknown persons. The informant suspects 7 accused persons. The petitioner is not among them. The name of this petitioner has surfaced during course of investigation where Ajay Thakur and this petitioner have also confessed regarding their indulgence in the occurrence.

4. Learned counsel for the petitioner has submitted that this case is based on suspicion. His name has surfaced

Patna High Court CR. MISC. No.70847 of 2025(3) dt.13-10-2025 2/2 during investigation only on the basis of confessional statement. Save and except confessional statement, there is nothing against this petitioner. Learned counsel for the petitioner has submitted that the petitioner is a man of clean antecedent and is in judicial custody since 24.04.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dumariya P.S. Case No. 34 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, Gaya.
